Terms of Use
These terms govern your use of the DataOrigin website, which is operated by DataOrbit Inc, a Delaware corporation doing business as DataOrigin ("DataOrigin", "we", "us"). By using the site you agree to them. If you do not agree, do not use the site. Licensing of environments, datasets or grader services, and participation in evaluations or the grader network, are governed by separate written agreements, which take precedence over these terms where they conflict.
1. Informational site
The site describes DataOrigin's products and collections. Descriptions, figures, volumes, scores and examples on the site are provided for general information, may change without notice, and do not constitute an offer, a warranty, or a representation about any specific dataset, environment or result that may be delivered under an agreement.
2. Sample material
The sample records, documents, audio clips, video clips and scanned pages shown on the site are synthetic or de-identified excerpts provided to illustrate the shape of DataOrigin's collections. They are made available for viewing on the page only. You may not download, copy, extract, scrape, redistribute, publish, train models on, or otherwise reuse any sample material, in whole or in part, without DataOrigin's prior written permission.
3. Intellectual property
The site, its design, text, graphics, code, animations and the DataOrigin name and marks are owned by DataOrbit Inc or its licensors and are protected by copyright, trademark and other laws. Except for viewing the site in a browser for its intended purpose, no licence to any of this material is granted. Third-party names and marks appearing on the site belong to their owners and are used for identification only; no affiliation or endorsement is implied.
4. Acceptable use
You agree not to use the site in any way that breaks the law, interferes with its operation or security, probes or tests its vulnerabilities, bypasses measures that restrict access or copying, submits false or misleading information through its forms, or uses automated means to access it beyond what ordinary search-engine indexing requires.
5. Enquiries and submissions
Information you submit through the site's forms is handled as described in our Privacy Policy. Submitting an enquiry does not create any obligation on DataOrigin to respond, to enter into an agreement, or to keep the enquiry confidential beyond what the Privacy Policy provides. Do not send confidential data, records or code through the site; any exchange of material for evaluation takes place only under a signed agreement.
6. Third-party services and links
The site uses third-party services to host pages and handle forms, and may link to third-party sites. DataOrigin is not responsible for the content, availability or practices of third parties.
7. Disclaimer of warranties
The site is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy and uninterrupted availability. DataOrigin does not warrant that the site will be error-free or free of harmful components.
8. Limitation of liability
To the fullest extent permitted by law, DataOrigin and its officers, employees, contractors and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to your use of or inability to use the site, even if advised of the possibility of such damages. DataOrigin's total liability for any claim relating to the site will not exceed one hundred US dollars. Some jurisdictions do not allow certain limitations, in which case these limits apply to the extent permitted.
9. Indemnity
You agree to indemnify DataOrigin against claims, losses and expenses, including reasonable legal fees, arising from your breach of these terms or your misuse of the site or its sample material.
10. Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute arising out of these terms or your use of the site will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction to protect intellectual property.
11. Changes
We may change these terms at any time by posting a revised version on this page with a new effective date. Continued use of the site after a change means you accept the revised terms.
